Crypto Regulation in France

Buying cryptocurrency is legal in France, and the exchange serving you must hold a crypto-asset service provider authorisation under the European Union's Markets in Crypto-Assets Regulation. The Autorite des marches financiers grants it and began accepting applications in 2024. Before that, French platforms operated as digital asset service providers registered with the same regulator, and those registrations did not carry a European passport. The transition ran until 1 July 2026. In a notice published on 5 February 2026 the Autorite des marches financiers reminded providers that after that date only authorised firms or firms notifying under Article 60 of the regulation could operate, that wind-down plans were due by 30 March 2026, and that operating without authorisation carries up to two years imprisonment and a 30,000 euro fine under the Code monetaire et financier. As of September 2026 the transition has ended. Retail buyers also get a 14 day right of withdrawal when acquiring crypto directly from an offeror.

Do I pay tax on crypto in France?
France taxes occasional disposals of digital assets by individuals under article 150 VH bis of the Code general des impots. As of September 2026, gains are subject to the flat tax at a combined 30 percent, made up of 12.8 percent income tax and 17.2 percent social contributions. Disposals are exempt entirely if your total disposal proceeds for the year stay at or below 305 euros, and exceeding that threshold makes every disposal in the year taxable. Since 1 January 2023 you can instead elect, irrevocably and on your annual return, to have the gains taxed under the progressive income tax scale. Habitual and professional traders fall outside this regime.
