Legal Status and Regulation
Buying cryptocurrency is legal in Germany, and the exchange you use must be authorised as a crypto-asset service provider under the European Union's Markets in Crypto-Assets Regulation. BaFin grants that authorisation and supervises the firms, with the Deutsche Bundesbank receiving application material through its payments and crypto supervision unit. The regulation's service provider rules began applying on 30 December 2024. Germany then set a short national transition in section 50 of the Kryptomaerkteaufsichtsgesetz: firms already operating lawfully under earlier German law could continue only until 31 December 2025. As of September 2026 that window has closed, so an exchange without a European authorisation cannot legally take on German customers. Two consumer rules travel with the regime. Retail buyers acquiring crypto directly from an offeror get a 14 day right of withdrawal at no cost under Article 13 of the regulation, and since 30 December 2024 the European transfer of funds rules have required originator and beneficiary information on crypto transfers with no minimum amount.
Buying Crypto in Germany
Germany combines an ordinary European buying experience with an unusually generous tax rule: hold crypto privately for more than a year and the gain is free of income tax. The exchange side is now fully European. As of September 2026 the platform you use must hold a crypto-asset service provider authorisation valid in the European Union, euros arrive over SEPA, and a handful of global brands have left the market rather than obtain one.
How buying works here
The first thing to check is which entity your account sits with, because the authorisation follows the entity. Kraken reaches German residents by passporting from Payward Ireland Limited, OKX through OKX Europe Limited in Malta, and Bybit EU through Bybit EU GmbH, which is supervised by the Austrian financial market authority and serves European Economic Area residents on that licence (source: exchange terms of service and Bybit EU site, September 2026). A platform holding an authorisation from any member state can serve you; one holding none cannot, whatever its app store listing says.
BaFin supervises the German end of that and keeps the national register, so a firm you cannot find in a European register is not a firm you should fund. Every venue runs kyc before your first deposit, usually a passport or identity card plus a video or photo identification step. One consumer protection is worth remembering. If you acquire crypto directly from an offeror rather than on a trading venue, Article 13 of the European regulation gives you a 14 day right of withdrawal at no cost.

SEPA Instant is the one to use where it is offered, since it lands in seconds and costs the same as the slower version. Card funding exists on most platforms and is the expensive route everywhere. Because SEPA credit transfers carry the sender's name, a transfer from an account in someone else's name will normally be returned rather than credited.

A gain is taxable only if you dispose of the asset within one year of acquiring it. Hold it longer and the gain is free of income tax.
Below that one year line, gains stay exempt if your total private sale gains for the calendar year come to less than 1,000 euros, a threshold raised from 600 euros for assessment years from 2024. Crypto received through lending or staking counts as a fresh acquisition and starts its own one year clock, so a reward token is not covered by the clock on the coins that produced it (source: Federal Ministry of Finance letter of 6 March 2025). Keeping acquisition dates alongside your cost basis is therefore the whole exercise.

Asset availability is the German-specific irritation. Kraken marks some crypto assets as restricted in Germany only, so a coin you can see quoted elsewhere on the same platform may not be tradable from your account.
