Crypto Regulation in the Netherlands

Buying cryptocurrency is legal in the Netherlands, and the exchange you use must hold a crypto-asset service provider authorisation under the European Union's Markets in Crypto-Assets Regulation. The Autoriteit Financiele Markten grants that authorisation and supervises conduct, while De Nederlandsche Bank supervises issuers of the two stablecoin categories, asset-referenced tokens and e-money tokens. Before the regulation applied, crypto exchange and custodial wallet providers only had to register with De Nederlandsche Bank under the Dutch anti-money-laundering act. The Netherlands set an unusually short transition: firms already registered with De Nederlandsche Bank before 30 December 2024 could keep operating without a European authorisation for six months, until 30 June 2025. As of September 2026 that window is long closed, and the Autoriteit Financiele Markten publishes a public register of the firms that may serve Dutch residents. Retail buyers acquiring crypto directly from an offeror get a 14 day right of withdrawal, and crypto transfers must carry originator and beneficiary information with no minimum amount.

Do I pay tax on crypto in the Netherlands?
The Netherlands does not tax realised crypto gains. As of September 2026, crypto holdings sit in Box 3, the levy on income from savings and investments, where the Belastingdienst taxes a deemed return on the value of your assets rather than what you actually made. You report the market value of your crypto on 1 January, using the rate on the exchange you hold it with, and a tax free allowance applies before the deemed return is calculated. Parliament is replacing this system with one based on actual returns; the lower house has passed the bill, the senate has not, and the government is targeting 1 January 2028.
