Crypto Regulation in Australia
Buying cryptocurrency is legal in Australia and there is no restriction on residents holding it. Any business providing digital currency exchange services must be registered with the Australian Transaction Reports and Analysis Centre under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006, a requirement in place since 2018. On 31 March 2026 that register was replaced by a broader virtual asset service provider register covering exchange, transfer, custody and participation in token offerings, with existing registrations converted automatically and full compliance, including travel rule obligations, required from 1 July 2026. A second regime is coming. The Corporations Amendment (Digital Assets Framework) Act 2026 received assent on 8 April 2026 and creates two new licensed categories, digital asset platforms and tokenised custody platforms, which will bring exchanges holding customer assets under the Australian financial services licence. As of September 2026 that Act has not commenced; it takes effect on 9 April 2027. The Australian Securities and Investments Commission updated its guidance on when a digital asset is a financial product on 29 October 2025.

- The Australian Taxation Office treats crypto as a capital gains tax asset, so selling it, swapping one token for another, or using it to pay for something is a disposal. As of September 2026, individuals who hold an asset for more than 12 months before disposing of it qualify for the 50 percent capital gains tax discount. A narrow personal use asset exemption can apply where crypto is acquired and used to buy items for personal consumption, but it is unavailable if the asset cost more than 10,000 Australian dollars, and it does not cover crypto held as an investment. Staking rewards and airdropped tokens are ordinary income at their value when received.
