Legal Status and Regulation

Buying cryptocurrency is legal in Spain, and the exchange serving you must hold a crypto-asset service provider authorisation under the European Union's Markets in Crypto-Assets Regulation, granted by the Comision Nacional del Mercado de Valores. Spain used the full transition available, and in a statement dated 15 June 2026 the regulator confirmed it ended on 30 June 2026, adding that from that date only providers holding the required authorisation may operate in Spain and that firms without it were executing plans to migrate their clients elsewhere. The earlier Banco de Espana register of virtual currency providers is now informational only and takes no new entries. As of September 2026 you can check whether a platform is authorised on the registers kept by the Comision Nacional del Mercado de Valores and the European Securities and Markets Authority. Spain also regulates crypto advertising: under the regulator's Circular 1/2022, crypto promoted as an investment must carry a risk warning, and mass campaigns must be notified in advance.

Buying Crypto in Spain

Spain finished its European transition on 30 June 2026, so the platform you buy from must now hold a crypto-asset service provider authorisation. Euros fund over SEPA at no cost on the main venues. The Spanish-specific thing to plan for is not the purchase but the paperwork: gains are taxed in the savings base, and holding crypto with a custodian outside Spain can trigger a separate annual information return.

How buying works here

Check the register first. The Comisión Nacional del Mercado de Valores confirmed in a statement dated 15 June 2026 that the transition ended on 30 June 2026, that from that date only providers holding the required authorisation may operate in Spain, and that firms without it were executing plans to migrate their clients elsewhere. The older Banco de España register of virtual currency providers is now informational only and takes no new entries, so a listing there proves nothing about a firm's current status. You can check a platform on the registers kept by the Comisión Nacional del Mercado de Valores and by the European Securities and Markets Authority.

Because authorisations passport across the European Union, your account will often sit with a non-Spanish entity. Kraken reaches Spanish residents from Payward Ireland Limited, OKX from OKX Europe Limited in Malta, and Bybit EU through Bybit EU GmbH under Austrian supervision (source: exchange terms of service and Bybit EU site, September 2026). Spain also polices the marketing. Under the regulator's Circular 1/2022, crypto promoted as an investment must carry a risk warning, and mass campaigns must be notified in advance, which is why Spanish crypto advertising reads more cautiously than its neighbours'.

SEPA Instant is the sensible default where a platform supports it, since it costs the same as the standard transfer and arrives in seconds. Card funding is offered almost everywhere and is the expensive route, with the percentage charge landing before you have paid a trading fee or crossed the spread. Taxes in practice

Spain treats crypto disposals as capital gains and taxes them in the savings tax base rather than at your general income rates, which usually works in your favour. The savings base is charged in bands, starting at 19 percent on the first 6,000 euros, then 21 percent to 50,000 euros, 23 percent to 200,000 euros, 27 percent to 300,000 euros, and 30 percent above that.

The reporting duty is separate from the tax and easier to miss. Modelo 721 is an annual information return for crypto held abroad with a third-party custodian, filed between 1 January and 31 March, and it is required when the combined balance on 31 December exceeds 50,000 euros (source: Agencia Tributaria). Since most authorised platforms serving Spain are established elsewhere in Europe, ordinary savers can cross that line without ever having moved money out of the country deliberately. Common problems

The disruption this year was a migration rather than a block.

Two smaller frictions recur. Withdrawals to an outside address can pause while the platform gathers originator and beneficiary details, because European transfer of funds rules apply with no minimum amount (source: Regulation (EU) 2023/1113). And the 50,000 euro Modelo 721 threshold is tested on a single day, 31 December, so a position that grew during the year can pull you into a filing obligation you did not have the previous January.
