Crypto Regulation in Switzerland

Buying cryptocurrency is legal in Switzerland, which regulates by economic function rather than by technology. There is no single crypto licence. Instead, the Swiss Financial Market Supervisory Authority decides which existing category an activity falls into. Most exchanges, brokers and over-the-counter desks operate as financial intermediaries under the Anti-Money Laundering Act through membership of a self-regulatory organisation recognised by the authority, which covers identification, monitoring and reporting duties. A firm taking public deposits needs a banking licence, or the lighter fintech licence, which permits deposits and crypto-based assets up to 100 million Swiss francs but carries no deposit protection for clients. The Distributed Ledger Technology Act, in force since 1 August 2021, added a dedicated trading facility licence, first granted to BX Digital on 18 March 2025. As of September 2026 the framework is being revised: the Federal Council consulted between 22 October 2025 and 6 February 2026 on replacing the fintech licence with payment institution and crypto institution categories, and that change is not yet law.
