Crypto Regulation in South Africa
Buying cryptocurrency is legal in South Africa, and since October 2022 the businesses that sell it to you have been regulated as financial services providers. In General Notice 1350 of 2022, published in Government Gazette 47334 on 19 October 2022, the Financial Sector Conduct Authority declared crypto assets a financial product under the Financial Advisory and Intermediary Services Act 2002, which means a crypto asset service provider needs a Category I licence, or a Category II licence where it manages assets on a discretionary basis. Applications ran from 1 June to 30 November 2023. Crypto asset service providers were separately added to the Financial Intelligence Centre Act as accountable institutions with effect from 19 December 2022, and the centre's Directive 9 of 2024 brought in the travel rule from 30 April 2025, requiring originator and beneficiary details to travel with transfers. As of September 2026 the South African Reserve Bank is consulting on bringing cross-border crypto transfers under exchange control.
