Crypto Regulation in Brazil
Buying cryptocurrency is legal in Brazil, and the country has had a statutory framework since Law 14.478 of 21 December 2022, which took effect on 20 June 2023. The law defines a virtual asset, requires any provider of virtual asset services to hold prior authorisation from a federal body before operating in Brazil, and applies the Consumer Defence Code to virtual asset transactions. Decree 11.563 of 13 June 2023 named the Banco Central do Brasil as that body, giving it power to regulate, authorise and supervise virtual asset service providers. The Comissao de Valores Mobiliarios keeps its separate jurisdiction over any token that is a security, an approach it set out in Guidance Opinion 40 of 11 October 2022, which sorts tokens by function into payment, utility and investment types. As of September 2026 there is no restriction on residents buying crypto; the rules govern the platforms rather than the buyer.

As of September 2026, Law 14.754 of 12 December 2023 charges a flat 15 percent on income from financial applications held outside Brazil, and it names virtual assets and digital wallets held abroad specifically. Gains on crypto held in Brazil fall under the general capital gains rules the Receita Federal administers. A 2025 measure that would have applied a flat 17.5 percent to virtual asset gains generally, Provisional Measure 1.303 of 11 June 2025, expired without being converted into law on 8 October 2025, so it never took effect.
