Crypto Regulation in Montana
Montana is the only state that does not license money transmitters at all. The Banking and Financial Institutions Division of the Montana Department of Administration states plainly that it does not regulate money transmitters; it licenses banks, credit unions, mortgage and consumer finance entities, escrow companies and retail sales finance companies instead. A crypto exchange serving Montana residents is therefore governed by the federal layer and by whatever other licenses its non-transmission activities require. Federal law comes first: a business that exchanges dollars for crypto on your behalf is a money transmitter under 31 CFR 1010.100(ff)(5) and has to register with FinCEN as a money services business, renewing that registration every two years. As of September 2026, Binance US lists Montana among its fully supported states and Kraken records no Montana restriction on its supported-states page.
