Crypto Regulation in Florida

Florida narrowed its rules in 2022. CS/H.B. 273, Chapter 2022-113, took effect on January 1, 2023 and reworked the money services business provisions of Chapter 560, defining virtual currency, excluding it from the calculation of permissible investments and easing the position of two-party sellers, so that a license turns on acting as an intermediary that can unilaterally execute or block a transaction. Federal law comes first: a business that exchanges dollars for crypto on your behalf is a money transmitter under 31 CFR 1010.100(ff)(5) and has to register with FinCEN as a money services business, renewing that registration every two years. Florida does not appear among the thirty-one states that had enacted the Conference of State Bank Supervisors' Money Transmission Modernization Act in whole or in part as of the CSBS legislative update dated June 2026. As of September 2026, Binance US lists Florida among its fully supported states and Kraken records no Florida restriction on its supported-states page.
