Crypto Regulation in Maryland

Maryland treats crypto exchanges as money transmitters rather than licensing them under a separate crypto regime. Federal law comes first: a business that exchanges dollars for crypto on your behalf is a money transmitter under 31 CFR 1010.100(ff)(5) and has to register with FinCEN as a money services business, renewing that registration every two years. On top of the federal layer sits a Maryland money transmitter license, and that license is what decides whether an exchange will open an account for a Maryland resident. Maryland has enacted the Conference of State Bank Supervisors' Money Transmission Modernization Act (regulations at COMAR 09.03.14, effective December 11, 2023), the model law that standardizes net worth, surety bond and permissible investment requirements; thirty-one states had adopted it in whole or in part as of the CSBS legislative update dated June 2026. Maryland is also amending the license itself: S.B. 261, effective October 1, 2026, exempts agents of the payor that provide payroll processing services from money transmitter licensing. As of September 2026, Binance US lists Maryland among its fully supported states and Kraken records no Maryland restriction on its supported-states page.
