Crypto Regulation in Maine
In Maine the question is not whether crypto is legal but which exchanges hold the license the state requires. Federal law comes first: a business that exchanges dollars for crypto on your behalf is a money transmitter under 31 CFR 1010.100(ff)(5) and has to register with FinCEN as a money services business, renewing that registration every two years. On top of the federal layer sits a Maine money transmitter license, and that license is what decides whether an exchange will open an account for a Maine resident. Maine has enacted the Conference of State Bank Supervisors' Money Transmission Modernization Act (L.D. 2112, effective August 9, 2024, including its virtual currency title), the model law that standardizes net worth, surety bond and permissible investment requirements; thirty-one states had adopted it in whole or in part as of the CSBS legislative update dated June 2026. Maine's adoption is notable for including the model law's virtual currency title rather than leaving crypto to interpretation. As of September 2026, neither Kraken nor Binance US serves Maine residents; Kraken names Maine and New York as its only two unsupported states, and Binance US lists Maine as unsupported.
